The Rules of Carriage

Introductory provisions

  1. These Rules of Carriage specify the requirements for Carriers who want to use the TransferBooking service under the conditions described in the License Agreement.
  2. The Rules of Carriage enter into force since the day of publication on the TransferBooking service website.

Definition of the main terms

“A Carrier” is a legal entity, an individual entrepreneur or a person whose main activity is related to the provision of transportation services using an own or leased vehicle. A carrier that provides passenger transportation services by car must comply with the requirements established by legislation at the carrier´s location and/or the location of such activities, as well as the requirements established by this Agreement.

“The Carrier´s Customer zone” is a section of the TransferBooking service, which contains the carrier identifier (identification information) and information about the Carrier, sets of personal settings for interacting with the Service, history created using the Service, information about Applications and other information necessary for performing transfer services. Customer zone is also used for communication between a Licensee and the Licensor.

 “A Transfer Service” is the same as “a Transfer”.

“A Transfer” – a single service of the transportation of the Client, which has a certain set of conditions, such as: the time of the commencement of the service, the place of the commencement of the service, the end of the provision of the service and the price of  the service.

“A Voucher” – a document confirming an order, which contains data on transfer Booking, information about the Carrier and other information and rules that are necessary for the carriage of passengers.

“A Passenger” – an individual that uses the Transfer Service on the TransferBooking service website.

Responsibilities of the Carrier

  1. To carry out Transfer Services according to the Rules of Carriage and in accordance with the established legislation at the place of his/her location and/or the place of implementation of such services.
  2. To perform Transfer Services according to a valid Voucher, which the Carrier receives in the Carrier’s Customer zone.
  3. To carry out safe and comfortable transportation of Passengers.
  4. To have insurance that would cover any responsibility of the Carrier for any damage to the health or property of the passenger.

Minimum vehicle requirements

A vehicle must be:

(A) A vehicle must be made no older than in 2012, equipped with a left-hand drive and have 5 doors.

(B) suitable for operation in accordance with the technical inspection and control of emissions;

(C) the exterior of  a vehicle  must be in excellent condition, without obvious signs of an accident, large scratches.

(D) a vehicle must be free of stickers and advertisements;

 (E) in the cabin of a vehicle are allowed stickers on the prohibition of smoking, as well as information about a WI-FI access;

(F) a vehicle must necessarily be insured for responsibility for any damage to the health or property of a passenger;

(G) smoking in a vehicle is prohibited;

(H) the trunk of a vehicle must always be clean and empty, except for the mandatory kit for any vehicle.

(I) a  vehicle must always be clean, both outside and inside.

Vehicle Class Definition

 For evaluation of the class of a vehicle and its designation in the Carrier’s Customer zone, the following requirements for certain classes should be used:

“Economy class” – the length of a vehicle is up to 470 cm. Examples of economy class cars: Mercedes-Benz C-class, BMW 3-series, Volvo S60, Toyota Camry, Citroen C4, Peugeot 307, Škoda Octavia, Toyota Corolla.

“Business class” – a vehicle with a high level of safety and comfort. The length of such vehicle is at least 460 cm, the width is at least 180 cm. Examples of business class cars: Mercedes-Benz E-Class, BMW 5-series, Volvo S80, Audi A6, Opel Omega, Škoda Superb, Citroen C6, KIA Cadenza, Hyundai Genesis, KIA Opirius, Honda Legend, Jaguar S-Type, Lexus GS 450h.

“ECO class” is a family of hybrid vehicles and electric vehicles. Examples of ECO class cars: Toyota Prius, Tesla Model 3, Nissan Leaf.

“Off-road” – a vehicle with excellent off-road qualities due to high ground clearance. Examples of Off-road SUV class cars: BMW X5, BMW X6, Audi Q7, Toyota Land Cruiser, Land Rover, Range Rover.

Premium class” – a vehicle with  luxurious and spacious cabin and expensive trim. The  length of a premium class car exceeds 500 cm. Examples of premium class cars: Mercedes-Benz S-Class, BMW 7-series, Audi A8, Jaguar XJ, Kia Quoris, Hyundai Equus.

For Mivans, Minibuses and Buses class is determined depending on the number of passenger seats.

“Minivan” – up to 9 seats;

“Minibus” – up to 20 seats;

“Bus” – at least 20 seats.

Driver Requirements

 Requirements for the driver of a vehicle:

(A) the driver must be at least 21 years old;

(B) the driver must have a driving experience of at least 3 years;

(C) the driver must have a driver’s license;

(D) the driver must look clean and tidy, he should not smell of any unpleasant odors including SWEAT and TOBACCO (allowed clothes are: a suit/ trousers / sweater / shirt; STRICTLY FORBIDDEN is Sportswear);

(E) The driver must address Passengers in a polite way (in English use “Mister” and “Madam”, in Slovak use “Vy” and not “Ty” form).

(F) The driver must open the door of the vehicle for the Passenger to get in and after the Passenger got inside he must close the door.

(G) The driver must open the door of the vehicle when the Passenger leaves the vehicle.

Requirements for the Transfer

Meeting at the airport:

(A) The driver should track the Passenger’s flight independently. The 60 minutes that Passengers are allowed to use to get out of the Airport begin only since the moment the aircraft lands at the destination airport.

(B) The driver should meet the Passengers in the arrivals area, hold a sign or a Tablet with the inscription indicated by the Passenger when ordering transfer on the TransferBooking service website.

(C) After meeting the Passengers, the driver must offer assistance with the luggage and guide Passengers to the vehicle.

(D) The vehicle must be parked at the airport car park, it is strictly forbidden to leave the car outside the airport.

 Meeting Passengers at a train station, bus station, at hotels and other places:

(A) The driver should meet the Passengers at the train station on the platform of the arrival of the train. The driver should monitor the delay of the train independently. 15 minutes, that are designated for the Passenger to exit the train, begin only since the moment of the arrival of the train at the final destination. The driver must hold a sign or a Tablet with an inscription indicated by the Passenger when ordering transfer on the TransferBooking service website. After meeting the Passengers, the driver must offer assistance with the luggage and guide Passengers to the vehicle. The vehicle must be parked at the train station car park, it is strictly forbidden to leave the car outside the train station area.

(B) The driver should meet the Passengers at the bus station at the bus stop of the arrival of the bus. The driver should monitor the delay of the bus independently. 15 minutes, that are designated for the Passenger to exit the bus, begin only since the moment of the arrival of the bus at the final destination. The driver must hold a sign or a Tablet with an inscription indicated by the Passenger when ordering transfer on the TransferBooking service website. After meeting the Passengers, the driver must offer assistance with the luggage and guide Passengers to the vehicle. The vehicle must be parked at the bus station car park, it is strictly forbidden to leave the car outside the bus station area (except there is no car park).

(C) The driver should meet Passengers at the hotel near the reception. The driver must hold a sign or a Tablet with an inscription indicated by the Passenger when ordering transfer on the TransferBooking service website. After meeting the Passengers, the driver must offer assistance with the luggage and guide Passengers to the vehicle. The vehicle must be parked close to the hotel.

 (D) Meeting Passengers at other places works on the same principles as the above meetings. More information about them is written in the Voucher.

During the transfer

  1. The Transfer is performed using the shortest route, taking into account the traffic situation.
  2. Passengers are obliged to: wear seat belts that are provided in the vehicle, not to interfere with the driver driving the vehicle, or restrict visibility of the driver in the front seat by hand luggage, newspapers, maps and other items.
  3. During the transfer the Passenger is not allowed to: smoke, eat and drink alcoholic beverages (except low-alcohol drinks) in the vehicle (for this, the Passenger may ask the driver to stop at special places).
  4. The driver is obliged to:

(A) follow the traffic laws;

(B) adhere to the speed limit;

(D) ask the Passengers to buckle up;

(E) address the Passengers  in a polite way (using “Vy” form in Slovak or Mister/Madam form in English);

 

The driver is prohibited from:

(A) talking on the phone;

(B) turning on the music, unless the Passengers themselves ask for it;

(C) smoking, eating in the vehicle;

(D) collecting the transfer fee before the completion of the transfer.

The completion of the Transfer

  1. After the vehicle arrives at its final destination, the driver helps the Passengers to get out of the vehicle and pull out their luggage.
  2. If the end point of the Transfer is a Hotel, the driver at the request of the Passengers should help to carry the luggage to the reception of the Hotel or to the porter at the Hotel entrance.
  3. If the Passenger, when ordering a Transfer on the TransferBooking Service website, paid 30% of the Transfer fee, then the remaining 70% must be paid immediately after arriving at the final destination.
  4. The driver is prohibited from changing the price of the Transfer.

Transportation security

Transportation of children:

(A) When ordering a transfer on the TransferBooking Service website, a passenger must request child car seats in a special menu or write this in the Comments box when ordering, specifying the number and age of children, as well as the required type of child car seats.

(B) Transportation of children is allowed only fastened to a child car seat.

(C) If during the transfer the Passenger needs to feed a child, it is necessary to get him/her out of the child car seat, so the driver must make a stop so that the Passenger can feed the child.

Number of passengers and luggage:

(A) The maximum number of passengers and luggage items specified for a particular vehicle is a rough estimate based on factors such as the size and weight of passengers and luggage, so these data are not strictly limiting.

(B) Passenger´s luggage may be transported in the passenger compartment of the car if it does not make the cabin dirty, if it does not obstruct visibility and if it can´t cause injuries.

(C) Crutches, canes, strollers, boxes, bags, skis, sledges and other things that may in case of an accident or a sudden movement of a car cause injuries to the driver or passengers, may only be transported in the luggage compartment. Luggage and other things are loaded and unloaded, put or installed by the driver.

(D) The driver may refuse to transport some luggage if he believes that it does not comply with the safety requirements.

(E) The driver may refuse to transport Passengers if their number exceeds the number indicated on the TransferBooking Service and may interfere with the visibility while driving.

 Transportation of animals:

The driver reserves the right to refuse to transport animals, if this was not specified in the application for the TransferBooking service and which are not kept in a closed and suitable for transportation cage.

An animal must be accompanied by a Passenger over 15 years of age. The animal must be transported in a tightly closed cage or transport box, provided by the Passenger.

A pet may also be transported in the passenger compartment under the following conditions:

– only one animal is allowed to be transported in the vehicle cabin;

– the driver of the vehicle and passengers should not object;

– the size of the cage or transport box for the animal should not exceed 30x40x40;

– the cage or transport box for the animal must be tightly closed and there should be no strong odor or noise coming out of it;

A specially trained dog assisting a passenger with disabilities is transported free of charge.

Emergencies

An emergency situation is:

(A) a traffic accident;

(B) a car fire;

(C) an accident or a sudden illness of a passenger or another person.

In case of an emergency, the driver of the vehicle has to:

(A) stop the vehicle immediately;

(B) take the necessary measures to rescue the passengers and their property;

(C) provide, in accordance with his capabilities and capabilities of the victim, the necessary first aid and emergency medical care;

(D) call the Police.

Refusal of transportation

The driver of the vehicle may refuse transportation if:

(A) the passenger is under the strong influence of alcohol or other substances;

(B) the passenger is aggressive or armed or otherwise makes the driver worried about his own  health and safety;

(C) the passenger has a luggage that, due to its size, weight or shape, cannot be transported;

(D) the passenger wishes to transport animals that, due to their size, characteristics or behavior, cannot be carried in the passenger compartment or in the luggage compartment.

Exceptional situations

Exceptional are such situations as a strike of air traffic controllers, extreme weather conditions, etc. This means that the waiting time for the client to occur can last indefinitely. In this case, 50% of the transfer fee is refunded to the Passenger and the driver is paid 25% of the transfer fee.

 Lost and found items

  1. If the driver finds in the vehicle items unknown to him, he is obliged to inform the owner of the lost things. If the owner of the found item is unknown, the driver is obliged to report this to his company and/or to the TransferBooking Service.
  2. If the person who has lost or forgotten items in the vehicle is without any doubts the owner of these items, then these items should be  transferred to him/her.
  3. The driver has the right to receive reimbursement from the Passenger for the delivery of these items to  him/her.
